PART II provides information that the Council has decided to make public on the adoption of other acts.

In the case of legislative acts adopted by ordinary legislative procedure, there may be a difference between the date of the Council's meeting where the legislative act is adopted and the actual date of the act in question, since legislative acts adopted by ordinary legislative procedure are only considered to have been adopted after signature by both the President of the Council and the President of the European Parliament and the Secretaries-General of the two Institutions.

All Member States in favour Statement by Germany Germany continues to have reservations regarding the broad wording of the derogation clause in Article 15(4) of the draft directive, but it is setting them aside to avoid putting the entire review procedure at risk. In comparison to the existing IPPC Directive, the draft contains core improvements which should not go unadopted, such as the introduction of a new obligation for the Commission to review the need for minimum requirements for emission reduction; strengthening of the application of best available techniques by compulsory establishment of emission limit values within BREF ranges; a clear raising of the requirements for large combustion plants; and the introduction of more uniform requirements for monitoring of installations. INFORMATION ON THE ADOPTION OF LEGISLATIVE ACTS NOVEMBER 2010 TITLE OF LEGISLATIVE ACT TEXTS ADOPTED VOTING RULE VOTES Statement by the Commission The European Parliament and the Council have decided, at the Commission's proposal, to remove the visa obligation for those nationals of Albania and Bosnia and Herzegovina who are holders of biometric passports. The Commission would stress in this context the great importance which it attaches to effective implementation of the measures taken by the countries of the Western Balkans to enduringly meet the benchmarks of the roadmaps for the visa liberalisation process.

To that end, the Commission is stepping up its efforts to establish a follow-up mechanism which will cover inter alia border management, document security, combating organised crime and corruption, effective implementation of readmission agreements and management of migration flows between the EU and the countries concerned. That follow-up will form an integral part of the Commission's annual reports on the progress of reforms in those countries.

It will also be systematically broached in the relevant Stabilisation and Association Agreement Committees. Moreover, this mechanism will have to be accompanied by the establishing of specific ways in which the European Union delegations, in collaboration with the authorities of the countries concerned, can keep their populations informed in order to forestall risks relating to abuse of asylum procedures. Emergency consultation arrangements will be introduced so that the European Union and its Member States can, in cooperation with the authorities of the countries concerned, react in the best possible conditions to any specific difficulties which might arise with flows of persons from the countries of the Western Balkans.

In the event of one or more Member States being confronted by an emergency situation characterised by a sudden inflow of nationals of one or more third countries, including nationals of the Western Balkans, the Commission may propose that the Council adopt provisional measures for the benefit of the Member State(s) concerned in accordance with Article 78 of the Treaty on the Functioning of the European Union, and a rapid suspension of visa liberalisation. The Commission will report back regularly to the Council and the European Parliament, starting six months after entry into force of the present Regulation and making use in particular of the results of work by experts from the Commission and the Member States, of the European Union delegations and of any relevant information of which the Member States are aware. In the emergency situation cited in the preceding paragraph, the Commission will inform the Council and the European Parliament by means of an ad hoc report. 5455/1/11 REV 1 CSM/AH

These arrangements are a first step and would be reviewed by 2014 with the aim of creating Union integrated crisis management and supervisory arrangements, as well as a Union Resolution Fund in the longer term. We have concerns in particular as regards the part of the definition of a non-interventional study in the Clinical Trial Directive which reads "a study where the medicinal product(s) is (are) prescribed in the usual manner in accordance with the terms of the marketing authorisation". As we understand it, this would mean that all studies addressing safety concerns not falling under the terms of the marketing authorisation (whether it involves uses according to well-established clinical practice, abuse, overdose, off-label use, misuse for illegal purposes, etc.) would be considered Clinical Trials.

A PASS can be interventional or non-interventional; however, in the case of a "non-interventional PASS", according to our understanding of the definition in the Clinical Trial Directive, the Pharmacovigilance Risk Assessment Committee set up in accordance with the proposed changes to Regulation (EC) 726/2004 will only be allowed to assess studies "with(in) the terms of marketing". Therefore studies addressing safety concerns that do not fall under a Marketing Authorisation would not come within the remit of the future Pharmacovigilance Risk Assessment Committee.

We hold that this legal problem must be solved during the revision of the Clinical Trial Directive and therefore request that the Commission treat this revision as a matter of urgency, with a view to ensuring that it will be possible for the PRAC to assess studies addressing safety concerns for uses of medicinal products not falling under a Marketing Authorisation. INFORMATION ON THE ADOPTION OF LEGISLATIVE ACTS NOVEMBER 2010 TITLE OF LEGISLATIVE ACT TEXTS ADOPTED VOTING RULE VOTES Statement by Slovenia Slovenia supports the general aims of the Directive of the European Parliament and of the Council as regards pharmacovigilance and the Directive 2001/83/EC on the Community code relating to medicinal products for human use. Nevertheless Slovenia abstained from the vote, because it continues to oppose Article 126a of the Directive. Slovenia is particularly concerned about possible negative effects of the application of Article 126a. The aim of the article is to improve the availability of medicines. Slovenia however believes that the provision will have only a limited impact on this availability, while at the same time potentially causing other public health concerns, particularly in small Member States. Slovenia's concern is that, although regulated as an option, Article 126a could create a parallel route for supplying the market with medicinal products while avoiding important regulatory obligations. This could lead to an undesirable penetration of the medical products to the markets without respecting regular marketing authorisation procedures including all Marketing authorisation holder (MAH) obligations. The provision implies no obligation to assume responsibility for pharmacovigilance, advertising to health care professionals, handling variations, labelling, patient information, summary of product characteristics and other activities normally required from MAH. It also remains unclear to whom the sanctions should be addressed to in the case of non compliance with the acquis. Slovenia believes that the simplification of Article 126a is at the very least premature, because the Commission has not yet presented a report on the implementation of the existing provisions, which it was expected to do already in April 2008. Such a report would allow a comprehensive discussion on modification of the current system. Slovenia expects the Commission to undertake all appropriate analysis and on their basis take further action in solving the issue of availability of medicines on small markets. 5455/1/11 REV 1 CSM/AH

The European Parliament, the Council and the Commission note that any of the provisions of a non essential character of the basic legislative act, which now are listed under Article 51 of the Regulation (delegation of powers), can become at any time in the future a significant element of the existing NEAFC control scheme from a political point of view, in which case the European Parliament, the Council and the Commission recall that either of the legislators, the Council or the European Parliament, can immediately exercise either the right to object to a draft Commission delegated act or the right to revoke the delegated powers as provided under Article 48 and Article 49 of the Regulation respectively.

The Council and the Parliament agree that the inclusion of any provision of the NEAFC control scheme into this Regulation as a non essential element, now listed under Article 51, does not imply per se that such provisions will automatically be considered by the legislators to be of a non essential character in any future Regulations.

3 The European Parliament, the Council and the Commission declare that the provisions of this Regulation shall be without prejudice to any future position of the institutions as regards the implementation of Article 290 TFEU or individual legislative acts containing such provisions. Statement by the Commission The Commission expresses concern that the limited powers delegated to it by the co legislators may hinder the timely implementation in EU law of measures taken by NEAFC in the future that revise or update the control scheme of this Organisation. The Commission therefore declares that it considers this Regulation to be without prejudice to any future position of the institution as regards the recourse to Articles 290 and 291 TFEU for the transposition of Regional Fisheries Management Organisation measures. The Council acknowledges the need to pursue discussion on the application of the reverse charge mechanism to counter specific types of fraud. When examining the remaining part of the Commission proposal of 29 September 2009, the Council commits itself to ensure appropriate consideration of those supplies for which Member States provide evidence of both the fraud resulting in considerable tax losses in Member States, and the reverse charge mechanism as an effective tool to address this problem. The derogation must expire on the date laid down in the above proposal. Italy considers that a derogation by definition implies that a time limit must be set on the transitional period, not that it should be repeatedly and indefinitely renewed. Italy would point out that the Swiss Federation has already been granted an initial transitional period and that the derogation affords it a possibility that is not open to the EU Member States. After a careful examination of the references to the electronic identification of dogs and cats, Romania considers that further commitments for financial and administrative efforts, exceeding the current ones, are not justified.

In order to insure the support and the active participation of the Romanian citizens in all policies aiming at the reduction of the number of abandoned animals, Romania considers important that any proposed solution should be cost effective, simple and in line with the EU provisions on the processing

Joint Council and Commission Statement on Ad pelagic stocks The Council and the Commission agree that it is appropriate to set the TACs for the pelagic stocks in the years 2011-2015 as necessary in order to reach FMSY by 2015.

Commission Statement on Ad cod plan evaluation The Commission in accordance with Article 26 of the Council Regulation (EC) No 1098/2007 will continue to evaluate the impact of the management measures on the cod stocks and in this regard has asked scientific advice from STECF on the rate of progress towards the targets of the plan. The evaluation will be communicated to MS and will form the basis for further discussion on the long term management for cod stocks in the Baltic Sea as appropriate.

Joint Council and Commission Statement on Ad effort system for cod The Commission and the Council agree that it is appropriate to analyse by March 2011 if possible and based on information to be provided by Member States concerned if flexibility for the national allocation of the days absent from port could be granted in line with the multi-annual plan for the cod stocks (Council Regulation (EC) No 1098/2007). Without prejudice to Commission's right of initiative in legislative matters, the Council invites the Commission to propose a respective amendment of the fishing opportunities regulation as appropriate.

Joint Council and Commission Statement on Ad bycatch (Article 6) The Commission and the Council recognize that non-target species are inevitably represented as a bycatch in the unsorted landings of the herring and sprat fisheries using trawls, Danish seines or similar gears of a mesh size less than 32mm and that these bycatches need to be quantified in order to set appropriate TAC levels in the future. Member States using such gear will ensure appropriate sampling of bycatch data in these fisheries and provide respective data to ICES and STECF in 2011. 5455/1/11 REV 1 CSM/AH

Joint Council and Commission Statement on Ad Fully documented fisheries

The Commission welcomes the initiative on fully documented fisheries as a possible way to forward to minimise discards. Extending it to the Baltic could be an interesting option and the Commission agrees to evaluate the potential of this initiative for the cod fishery in the Baltic Sea in line with the multi-annual plan for the cod stocks in the Baltic Sea Council Regulation (EC) No 1098/2007. Without prejudice to the Commission's right of initiative in legislative matters, the Council invites the Commission to propose an amendment of the fishing opportunities regulation to introduce a quota premium as incentive for the introduction of this system if deemed appropriate according to STECF advice without prejudice to the principle of relative stability.

Joint Council and Commission Statement on Ad Western Baltic Herring The Commission and the Council agree that reduction of fishing mortality for the Western Baltic Spring Spawning Herring stock needs to be achieved in 2011 in line with the scientific advice and that an equal reduction for both management areas needs to be applied pending the outcome of the negotiations with Norway for management area IIIa. The Council and the Commission conclude that the prospective long term management plan for pelagic species and future TAC decisions must take full account of the relevant scientific advice on the distribution of the Western Baltic spring spawning herring in subdivisions 22-24 and in area IIIa.

Council Statement on Ad Sprat The Council invites the Commission to consider additional scientific data to be submitted by Member States and, if appropriate, to present a proposal

to amend this regulation.
